  • Vogt, Resnick & Sherak recently and successfully defended a breach of trust action by establishing a breach of a “no-contest clause” by the petitioner-beneficiaries. The matter was unique because interpretation and enforcement of the no-contest clause was governed by prior California law predating changes in the law which became effective in 2010. The end result was that the petitioners’ claims for damages were dismissed, and they were ordered to return to the trust all distributions they had received in the past, with interest. The trial court decision was affirmed on appeal.
  • Following the unexpected death of one client, Vogt, Resnick & Sherak was able to defend through a lengthy federal estate tax return audit, the concise and cohesive family business ownership structure it designed and reach a very favorable settlement for the heirs of the client.  This settlement saved the family from having to pay a large amount in additional estate taxes, as well as allowed the family business to grow rather than have to liquidate in order to pay the taxes.
